Recent Developments Affecting NFA Registration Requirements

Over the past several weeks, our office has been reviewing recent court decisions and federal regulatory guidance concerning the National Firearms Act. Recent changes in law have made the NFA's registration requirements for suppressors and short-barreled firearms unconstitutional. Indeed, our office has challenged those requirements in ongoing litigation in Missouri. In the meantime, ATF has announced that, for similar reasons, it will not enforce those registration requirements. Thus, based on that review, we believe that under both federal and Nebraska law, Nebraskans can presumptively possess silencers and short-barreled firearms without registration unless disqualified by some other provision of federal law (i.e., a felony conviction).
